Am I Allowed to Dial Outbound on TrackDrive?
TrackDrive has Lead to Call Automation, but Who do we Allow to use our Outbound Technology?
Early in 2023, the FCC started being more strict about their "Know Your Customer" Policies (aka KYC). In seeing Trace Back notices referencing companies who couldn't possibly know what a client of a client was doing, we jumped into action and have come up with solutions to ensure, we truly do know our Customers that are doing outbound dialing.
Until the following procedures are put in place, the current process is:
- Manually get information about the company and ask the Co-Founders of TrackDrive is the company may be approved.

Allow but Inform the client of what they should be doing:
- Full automation of unattended contact with a client including not checking the Federal DNC is allowed if the TCPA wording of the form list YOU or your Call Center that is calling on our behalf is listed.
- If you are purchasing leads and were not listed, you should not be calling unattended with AI Bots, SMS sends, Email Sends, and should be scrubbing both Federal and State Level DNC lists, and using TrackDrive in “Preview Leads” Mode where you see the upcoming leads to be called, and manually mark the leads you want to call.
- If you end up on a call that takes too long and approved too many leads, they will go back into Preview Mode for you to approve to dial again.
What is TrackDrive Doing to Protect themselves and You?
Step 1) Verify Your Company/Officers of the Company:
- TrackDrive is researching companies (e.g. - Persona) that has technology to help check to see if your company is legit and the EIN supplied to show you are registered with the USA (or other business documents in other countries).
- Do a Person Verification which includes scanning government issued photo ID, doing facial recognition on a live AI Video call, including having the person being verified make movements and read phrases on the screen to ensure they are not verifying against a photo of the person.
Step 2a) Verify that any data being called has TCPA opt-in for unattended Lead to Call Automation:
Any data that is being dialed out on TrackDrive will be Verified by 3rd Party Data Validity Companies, some are FREE to use, while others will have a Per Lead Verification that will cost per lead to verify.
TrackDrive will implement the following 3rd Party Verification Methods:

Jornaya - TrackDrive has an Account that will be used to ensure that the Phone on the lead in the system matches one of our approved Landing Pages where the form has been filled out. This method does not supply any data other than:
- The amount of time since the lead was submitted
- Verification that the lead was submitted at one of our Approved Sites
- Verify the phone number and email we have for the lead is what was submitted.
- Cost per lead for this service is estimated to be at around $0.01 per lead.
- Trusted Form - Same logic we have for Jornaya
- PermissionTrust - This is a FREE service that can either be used as a stand alone script on the form, or in conjunction with Jornaya and/or Trusted Form also being on the same landing page. PermissionTrust will auto detect the existence of the Jornaya Lead ID and/or the Trusted Form Cert URL so that the API to Verify your Data can use the PermissionTrust Token, Jornaya LeadID, or the Trusted Form Cert URL. If your leads have the PermissionTrust token available, this method will be attempted before using the For Fee methods above.
- TrackDrive Google Tag Management Tag/Variable Templates. For any site using GTM on their Form Pages, the TrackDrive Template can be used to send information about the Form Page and the Thank You Page, and for sites that have been Approved allow this data to use our Lead to Call Automation as prove of the lead's origins.
Step 2b) Unverified Data can still be called in Automated/Manual combined method:
It is important to know that even tho you loaded data before we could implement these policies, we will start vetting data that is being dialed in Unattended Mode, and mark any leads we can't verify to be in Preview Mode and scrubbed passed the Federal and State Level DNCs.
This means that you must be able to provide any missing tokens to that data, in order for it to go back into Unattended Contact Mode. It is important now, that you start providing the above tokens or get the GTM TrackDrive Template to your lead suppliers if you want to contact you leads with any automatic/unattended method of contact for any Outbound Reach to a consumer.
Current TCPA Laws have been in place since 2015 that regulate unattended contact methods, and until recently, it was upon the company pressing go, that the regulations mattered as long as a company like TrackDrive was not complicit in helping knowing the data was not opted in.
Starting in Janurary of 2025, this consent is no longer just to have your company listed as someone who may call with these methods, but that the consumer must give 1 to 1 Consent per Company that will be calling. We are currently working on Google Tag Manager Templates to help you get in compliance without having to edit every site, and a working example of what the plans are can be seen here on this website example that is still under construction.
